How to Address an Unauthorized Seller on Amazon
Distinguish unauthorized distribution from listing abuse, counterfeit evidence and enforceable rights before reporting an Amazon seller.
Define what unauthorized means in this case
A seller may lack a brand's distribution permission yet still offer genuine goods obtained through another channel. That commercial disagreement is different from counterfeit supply, false brand use, altered catalog content or a product that materially differs from the detail page.
Record the conduct you can observe: seller identity, condition, price, fulfillment, product differences, trademark use or catalog changes. Do not begin with a legal conclusion that the evidence has not established.
Create four evidence groups
Keep dates, ASINs and seller identifiers consistent. Distribution agreements can explain authorization but do not, by themselves, prove a product or listing violates an Amazon policy.
- Offer: seller ID, offer URL, condition, fulfillment and Buy Box status
- Product: test-buy order, packaging, labels, serials and observable differences
- Catalog: title, images, brand, bullets and variation changes
- Rights: trademark, copyright, patent or contractual records relevant to the conduct
Select the narrow reporting route
Use the current Brand Registry, rights-owner or Amazon support route that matches the evidence. A counterfeit report should rely on product-level proof; a trademark report should identify the protected mark and infringing use; a listing-field change should identify the inaccurate field and source-of-truth value.
Ask for the action supported by the record. Combining unrelated allegations can make a reviewer unable to identify what should be investigated.
Preserve results and distribution controls
Save report IDs and complete responses. Separately review serialization, reseller agreements, channel monitoring and inventory traceability. Those controls may reduce future problems even when a marketplace report is not the correct enforcement tool.
